USailor (usailor.com) is a product of Instinctor, based in Philadelphia, Pennsylvania, USA. These terms apply to everyone who uses USailor: boat owners, marine service businesses and their team members, marinas, and visitors. By using USailor you agree to them.
USailor is a marketplace and software platform. It helps boat owners find marine service businesses, helps those businesses run their work, and helps marinas manage the businesses that work on their premises. USailor does not perform marine services, does not employ the businesses listed on it, and is not a party to any agreement between an owner and a business. Owners and businesses deal with each other directly and are each responsible for what they agree.
You must give accurate information and keep your login private. You are responsible for what happens under your account. A business account may have team members, and an organisation may manage several locations; the account owner is responsible for the people they add.
Business listings may be created by the business itself or by USailor from information the business has published. How listings are created, claimed, ranked, edited and removed is set out in the Listing Policy, which is part of these terms.
Using USailor is free for boat owners and for marinas. USailor does not charge a fee per job, per request or per reply. Some business features require a paid membership; its price and billing period are shown before a business subscribes, and nothing is charged without the business agreeing to it. Businesses that join during the founding period keep the founder price shown on their dashboard, as stated there.
An owner's request is sent to every business whose trades and service area fit the work and the marina where the boat is kept and, where the law requires a licence for that work, that meets the requirement. Each business may send a limited number of quotes and visit offers a day. The limit is the same for every business and cannot be bought.
A business may upload insurance certificates, licences and certifications. When USailor shows a document as verified, it means the document was reviewed against a fixed checklist on the date shown, and a badge disappears automatically when the document expires. It is not a guarantee that coverage is in force, that a licence is valid today, or that work will be done well. Some work, such as carrying passengers or towing a boat for hire, legally requires a licence; the business is responsible for holding it. Owners should confirm what matters to them before hiring.
Quotes, invoices and bookings on USailor are agreements between the owner and the business. USailor does not collect or hold payments for marine work; payment is made directly to the business by the method it states. A fixed-price service is priced from the boat details the owner has entered, and the price shown when booking is the price agreed for each visit. Either side may cancel a booked visit, and the owner may move a single visit, free of charge up to 24 hours before it starts; a later cancellation or move is recorded on the visit.
A job is complete when the business marks it done. The owner may confirm it, or report a problem within 30 days. USailor does not decide disputes between owners and businesses: the business can answer or fix the work, and the owner records the outcome, which is shown on the business's profile as part of its record. Only the owner of a completed job on USailor can review it, once, within 60 days of completion, and may edit the review for 30 days. A business may reply once. Reviews are removed only if they break these terms.
A marina that claims its listing may set requirements for businesses working on its premises, such as insurance limits. USailor checks a business's verified documents against those requirements; it does not decide who a marina admits. A pass to work at a marina is issued only after the boat's owner authorises it and only while the business meets that marina's requirements. The marina, the business or the owner may revoke a pass. Any fee a marina charges is the marina's, under its own terms.
A boat's service record belongs to the boat's owner. It is shared only through links the owner creates, and the owner can revoke any link. When a boat is sold, its record may move to the new owner as described in the Privacy Policy.
Do not post false or misleading information, impersonate anyone, list a business you do not represent as your own, write reviews of work you did not receive, harass other users, send spam, scrape the site, try to get around security, or use USailor for anything unlawful.
We may suspend or remove an account or listing that breaks these terms, is fake or a duplicate, involves fraud, or puts customers at risk. We will tell the account holder the reason where we can.
USailor is provided as is. To the extent the law allows, Instinctor is not liable for the work, products, conduct or insurance of any business, owner or marina, or for indirect or consequential damages. Our total liability for any claim relating to USailor is limited to the amount you paid USailor in the twelve months before the claim.
These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws rules. Any dispute with USailor that cannot be resolved by good-faith email exchange must be brought in the state or federal courts located in Philadelphia County, Pennsylvania.
We may update these terms. We will post the new version here with a new date and, for material changes, tell account holders in advance.
